Lawsuits

  • Federal Lawsuit 2003 | Unknown | Court of Appeals of Georgia | A03A1064, A03A1065 Names this facility

Outcome: Judgment against the Department of Human Resources and Department of Juvenile Justice reversed; verdict against Broken Shackle Ranch affirmed.

Following a jury verdict in favor of the plaintiff for the wrongful death of a minor in state custody who was placed at a private facility, state agencies appealed the denial of their motion to dismiss based on sovereign immunity under the Georgia Tort Claims Act. A co-defendant facility also appealed, contending the verdict was excessive. The appellate court held that the state agencies were immune from suit under the Tort Claims Act because independent contractors and corporations cannot be considered state employees, thereby reversing the judgment against the state agencies while affirming the verdict amount against the facility.
