The agency is non-compliant with this rule. The agency does not have a specific behavior management policy that discusses how to informally resolve minor youth misbehavior or a range of interventions that may be imposed for violation of programming rules. Technical Assistance: The agency did not have a specific behavior management system that had guidelines for resolving minor misbehavior. Both Staff discussed restraints as the behavior management system. Administrator was unable to provide a policy that outlined the written guideline for resolving minor behaviors that do not require restraints. There appears to be confusion concerning the behavior management system, including daily interventions used to correct behaviors, and the restraint policies and procedures. Although these are closely related, and sometimes overlap, they are not the same. An example was given by Administrator. Administrator reported they used to conduct “group attentions” and discuss expectations before transitions and after transitions. They also used group attentions as a tool to intervene when youth were doing behaviors prohibited by the facility. Administrator reported they do not do those anymore but felt that those need to be implemented again. The agency will need to create a policy and the procedures that outline R. 400.4157 and complete training for all staff so that they are aware of the interventions and new policy updates. The agency is non-compliant with this rule. Both Staff 1 and Staff 2 did not intervene to provide for the continual needs, protection, and supervision of youth in their care. Interviews and video 10 observation reveal youth were able to wrestle with each other and “horseplay” for roughly nine minutes with limited intervention from staff. Both Staff 1 and Staff 2 reported they did not intervene.

Allegation #1: There is a violation established regarding this allegation. Per interviews and footage, Staff 2 does make contact with Youth B’s face with his right hand at least once. Allegation #2: There is no violation established regarding this allegation. Staff 1 denied spitting on or choking Youth B during the restraint outside 8 the building. There were no other reports of Youth B being spit on or choked by any other staff or youth interviewed. Youth B’s initial interview did not include allegations of being spit on or choked.

Allegation #1: There is a rule violation established regarding this allegation. It was reported by multiple staff and youth that Youth B was restrained while outside. There was no supporting rationale for engaging in a restraint during this time as Youth B was reported to be running at the time. Although Staff 1 reported Youth B had a weapon in his hand, remaining parties denied this detail and further denied Youth B was actively swinging at anyone including himself. Allegation #2: There is a rule violation established regarding this allegation. In review of video footage it is shown that Youth B is throwing chairs away from others and not actively engaging in any physically aggressive behavior towards himself or others when he is pulled from the counter and held in a restraint.

It was confirmed by Program Manager there is no written account of 12 the reported restraint that occurred outside on 2/24/2026 of Youth B. Applicable incident reports fail to include this restraint. Allegation #2: There is a rule violation established regarding this allegation. Incident Report documents restraint occurring for Youth B inside the building. The incident report does not include details regarding Staff 2 being asked to switch out with Staff 3 due to Staff 2’s hand making contact with Youth B’s face.

Violation established, special investigation : CCI Rule 400.4158 Intervention standards and prohibitions
The agency is in violation of this rule. Based on interviews with youth and staff, Staff 1 was verbally aggressive with Youth A. He swore at Youth A and threatened Youth A. The incident report written on 2/8/25, confirmed he threatened Youth A by threatening to “whoop his ass.” Staff 1 also called Youth A derogatory names. Technial Assistance: Staff 1 was hired by the agency through a “temp agency.” It was noted on the personnel file that he was hired on 10/7/24, yet he received the agency’s orientation on 9/12/24. Staff 1 was employed and received financial compensation from the agency for this orientation. R. 400.4128 (1) states, “the licensee shall provide an orientation program for new employees…” Staff 1 was considered an employee when he received orientation; therefore, all other rules outlined in the Licensing Rules for Child Caring Institutions, must be followed. Administrator 2 reported the agency 4 no longer uses the “temp agency” and that they were only used for a critical time for the agency. If the agency decided to use a “temp agency” in the future, policies and procedures will need to be completed to ensure this method of hiring is in accordance with rules.

The agency is found in non-compliance as per Supervisor Y’s interview he admitted to taking Youth A to the ground on his stomach and then laying on him for approximately five to six minutes, in order to stop the youth from fighting and manage the environment.

The facility is found in noncompliance as notifications shall be made immediately to law enforcement, the parent/legal guardian or next of kin, the licensing authority, and the referring agency. Youth B went AWOLP on 11/9/2024 per the behavior notification however it is unclear on the time of the AWOLP due to the time section being left blank. The facilities assigned consultant was notified via email at 2:48am indicating Youth B was AWOLP and law enforcement had been contacted and notification was made to the referring agency at 7:15am. TECHNICAL ASSISTANCE: The facility thoroughly complete reports to include all sections are filled out properly.

Violation established, special investigation : CCI Rule 400.4532 Fire extinguishers
The facility is found in noncompliance as per onsite inspection on 11/19/2024 the fire extinguishers in Clarence Fischer Center were stored in the supervisor’s office which not all staff had keys to. Per interviews, the fire extinguishers were moved in order to be behind locked doors due to youth inappropriately using the fire extinguishers which is allowed per the rule however all staff have to have keys to access the fire extinguishers which staff did not. 11 The fire extinguishers in the supervisor’s office were sitting on the floor and not 4 inches off the ground. The facility has since implemented a new key process and all staff now have access to the fire extinguishers. Per interviews concerns were reported regarding fire extinguishers in Camp 3 however Camp 3 building is not tied to this license and is not a licensed building and youth are not supposed to be in Camp 3.

The facility is found in noncompliance as Staff 1 slammed Youth A into the wall per Youth A’s interview and video footage. Staff 1 also pushed Youth A per video footage. Staff 1 originally reported he used his shoulder to guide Youth A into the wall however in later interview Staff 1 admitted to pushing Youth A into the wall to prevent Youth A from going outside.

Repeat violation established, special investigation : CCI Rule 400.4126 Sufficiency of staff.
The facility is found in compliance as per staff and youth interviews, the youth were not wandering the city until they were located by law enforcement. Youth and staff reported the youth got out of the van just down the road, on the same block as JDC, and were being followed by staff in the van until law enforcement apprehended them approximately 10 – 12 minutes later. The facility is found in noncompliance as there were not additional staff on shift to help provided adequate supervision of the youth who left the units, broke into the supervisor office and stole the van keys. The facility was in ratio but did not have adequate staff to provide for the continual needs and protection of the youth. The facility is found in compliance as per staff and youth interviews, medication was not reported to have ever been broken into and stolen.

The facility is found in noncompliance as per staff and youth interviews, the four youth were placed in handcuffs and leg shackles while being transported to JDC. The facility’s policy at the time allowed for youth to be transported in handcuffs but the policy was a direct violation of licensing rules.
