Lawsuits

  • Court opinion - Hillside Children’s Center 2007 | Unknown | New York Appellate Division, First Department | 2007 NY Slip Op 08279 [45 AD3d 260] Names this facility

Outcome: Order granting plaintiffs summary judgment as to liability for negligent failure to exercise professional judgment and denying defendant's cross motion for summary judgment is unanimously affirmed.

Plaintiffs filed an action against a treatment facility for emotionally disturbed youth to recover damages after two infant plaintiffs were abused by a resident during unmonitored home visits. The resident, who had a well-documented history of pedophilic behavior, was admitted to the facility for treatment. The appellate court affirmed the lower court's grant of summary judgment on liability in favor of the plaintiffs, finding that the facility failed to exercise professional judgment when granting home visit privileges without assessing the family's ability to supervise the resident.
