Petition - Pathfinders Wilderness Program
Outcome: Petitions for extraordinary relief granted in part and denied in part; tort and civil rights claims found time-barred by the one-year statute of limitations following emancipation, but intentional misrepresentation and fraud claims allowed to proceed.
A former youth program participant filed a lawsuit alleging mistreatment during her enrollment and transportation to a wilderness program for troubled youth. Defendants moved for summary judgment arguing that the claims were barred by the statute of limitations because the plaintiff was emancipated prior to turning 18. The appellate court ruled that the statute of limitations for personal injury and civil rights claims began upon emancipation and was not tolled for minors, rendering those claims time-barred, while allowing fraud and misrepresentation claims to proceed.
