Outcome: The court granted a motion to dismiss with prejudice, closing the case.

The plaintiffs, owners of several residential treatment programs, sued the defendants for breach of contract and conversion over misdirected payments. The defendants failed to remit the payments to the plaintiffs as required by the purchase agreement. The court found the plaintiffs had a substantial likelihood of success and granted the motion for a writ of replevin. The order was signed by Magistrate Judge Paul M. Warner on February 18, 2015.

  • Memorandum - Elevations RTC (case no. 2:2014cv00866) 2015 | Dismissed | United States District Court for the District of Utah Central Division | 2:14cv866 Names this facility

Outcome: The court granted the motion to dismiss with prejudice, closing the case.

Plaintiffs, who purchased several residential treatment programs and therapeutic boarding schools from Sellers, filed a lawsuit alleging that Defendants wrongfully withheld misdirected payments and accounts receivable collected after the asset purchase. Defendants counterclaimed for breach of contract, arguing that Plaintiffs committed material breaches first, thereby excusing Defendants from performance. The court determined that Plaintiffs demonstrated a substantial likelihood of success on their breach of contract and conversion claims and met the requirements for a prejudgment writ of replevin.
