Lawsuits

  • Court opinion - Youth Villages Unknown | Supreme Court of Utah | 20030087 Names this facility

Outcome: The district court's grant of summary judgment in favor of the defendant is reversed, and the case is remanded for further proceedings, holding that a civil claim for negligent placement is cognizable under Utah law and is not barred by the delayed discovery statute of limitation for child sexual abuse.

Jake and Jana Savage, along with their minor son John Doe, sued Utah Youth Village for negligent placement, fraud, breach of contract, and negligent infliction of emotional distress after a foster youth placed in their home sexually abused their child. The district court granted summary judgment to the defendant, citing Utah Code section 78-12-25.1. The Utah Supreme Court reviewed the case and decided on December 3, 2004. The appellate decision affirmed the district court’s ruling, concluding that the statute barred the plaintiffs’ claims. The case was closed following the Supreme Court’s decision.
